Acceptable Use Policy
This Policy is part of the Public Offer. It defines what may and may not be hosted and done using the services of PodiCloud, so that the service remains safe and stable for all customers. The terms used have the meanings given in the offer.
1. Prohibited content
The following may not be hosted, stored or distributed in Projects:
- materials whose hosting violates the legislation of Ukraine;
- objects of copyright and related rights without the permission of the rightholders, and means of circumventing the technical protection of such objects;
- malicious software, phishing pages, materials intended for fraud and for misleading people;
- materials containing the sexual exploitation of children;
- calls for violence, terrorism or the violent overthrow of the constitutional order, incitement of hatred, propaganda of war and other materials whose distribution is prohibited by law;
- offers of goods and services whose circulation is prohibited or requires a permit that the Customer does not hold;
- personal data of people collected or distributed without lawful grounds.
2. Prohibited actions
- sending unsolicited messages (spam) through any channel;
- carrying out denial-of-service attacks, scanning other people's networks and ports, brute-forcing passwords, obtaining or attempting to obtain unauthorised access to other people's systems and data;
- running publicly accessible proxy servers and exit nodes of anonymity networks;
- mining cryptocurrencies;
- interfering with the operation of the platform: circumventing the limits of the Plan, attempting to break out of the Project's container or to gain access to other customers' data or the Provider's infrastructure;
- impersonating another person or concealing the origin of traffic in order to breach this Policy.
3. Resources
3.1. The processor time, memory and disk of a Project are guaranteed within the limits of the Plan and are capped technically: a Project cannot use more than the Plan provides.
3.2. If the Plan limits the monthly traffic volume, once it is used up the Project's connection speed is reduced until the end of the calendar month; the Project keeps running.
3.3. Only the ports issued by the Control Panel are reachable from outside. Web traffic is accepted on the domain names linked to the Project.
4. Security
4.1. The Customer keeps the software of their Projects up to date, uses strong passwords and does not pass credentials on to third parties.
4.2. If a Project has been compromised and is being used for actions prohibited by this Policy, the Provider may suspend it until the causes are eliminated. The Customer remedies the consequences of the compromise themselves.
4.3. Please report vulnerabilities in the Provider's platform to [LANDING_SUPPORT_EMAIL] and do not exploit them.
5. Mailings
Emails and other messages may be sent only to recipients who have consented to receive them, with an option to unsubscribe in every message.
6. Information about the website owner
A Customer who is the owner of a website shall make accurate information about themselves freely available on it, to the extent defined by the Law of Ukraine “On Copyright and Related Rights”: full name or business name, place of residence or location, email address and telephone number.
7. Complaints
7.1. Report breaches of this Policy to [LANDING_SUPPORT_EMAIL]. State the address of the page or resource, the substance of the breach, evidence (screenshots, email headers, logs with the time of the event) and a contact for reply.
7.2. Notices of infringement of copyright and related rights are considered in the manner established by the Law of Ukraine “On Copyright and Related Rights”; a notice must meet the requirements of that Law.
7.3. We consider the complaint, ask the Customer for an explanation where necessary and inform the complainant of the outcome.
8. What happens in the event of a breach
8.1. Depending on the severity of the breach, the Provider may send a warning demanding that the breach be remedied, restrict or suspend the operation of the Project or the Account, or terminate the Agreement.
8.2. A Project is suspended without warning if the breach threatens the infrastructure or other customers, if the content is manifestly unlawful or if an authorised state body so requires.
8.3. If the Agreement is terminated for a breach of this Policy, the funds paid for the current Billing Period are not refunded. The unused remainder of the monetary funds on the Balance is refunded in the manner defined by the offer, less the losses caused to the Provider.
9. Requests from state bodies
The Provider discloses information about the Customer and the contents of Projects to state bodies only on a lawful demand and within the limits established by law.
